Loqate Inc. (”Loqate”) takes the protection and security of your personal information very seriously. Loqate is part of the group of corporate companies belonging to GB Group PLC group of entities (collectively, “GBG”).

This Privacy Statement explains how and why Loqate collects and uses your personal information when you are using any of our services, software, or websites that link to this Privacy Statement, when you interact with any of our employees, or when we are performing any of our services on behalf of our business clients (collectively, “Services”).

Please read this Privacy Statement carefully because by accessing or using any of our Services you agree that you have accepted all of its terms. Please note that the Services are only intended for use by individuals who are over the age of eighteen.

What personal information does GBG collect and why?

The majority of personal information that we collect on individuals, with the exception of any B2B personal information (detailed below), is provided to us by our B2B clients for us to process on their behalf as their service provider/processor. We perform these services to help our business clients better serve their consumers and to help with their cost-savings. The services we perform for our B2B business clients as their service provider include the following: name, phone, email, and address validation/verification, cleansing, and de-duplication, deceased suppression, do not mail validation, reverse geocode and storefinder services. Some examples of how these services help our clients include helping them ensure that they are: mailing you at the right address, not sending you mail if you are on the DMA choice Do Not Mail list or not send mail to you deceased relatives, not have duplicate records on you, etc.

Therefore, we may collect the following personal information on you from our business clients or from other service providers that we use to provide our business clients with the information we need to perform our contractual obligations to those same business clients. This information may include the following categories of personal information: name, phone, email address, physical address and non-precise geolocation. Please see our Products & Services Privacy Notice for additional information on our products and services and the information that they collect and process.

If you are a business client or a prospective business client, we may also collect the following information from you: name, title, business contact details such as business address and business phone number, business credit/debit card billing information, user IDs and passwords, IP address, survey responses, and any additional information that you provide to us directly or through our websites or software applications, when you are requesting a brochure from us, requesting a call back, during sales calls, if you attend our events or participate in our contests or sweepstakes, or if you request further information from us. We use this for business and commercial purposes, such as being able to reach out to potential business prospects and to transact with our clients.

If you are applying for a position at Loqate we may ask you to provide additional information including your name, age, date of birth, contact details, employment history, education background, skills, and other information that we deem relevant to properly assess you as a potential candidate.

Loqate does not knowingly or intentionally collect personal information from anyone under 18 years of age. If you are under 18 and believe that Loqate has collected personal information on you please contact us immediately at Loqate_DPO@gbgplc.com.

 

Who will we share your personal information with and why?

Loqate will share your information with the following: our parent company and our other GBG affiliated companies, our business clients, third party vendors and service partners who are acting on behalf of Loqate as our service providers, including but not limited to software and cloud service providers. We may also share your personal information with third parties in response to any compliance or legal obligations or proceedings, subpoena, court order, request from any government or law enforcement agency, legal claims, to exercise our lawful rights, or for any other legal reasons. Additionally, we may also share your personal information with third parties as part of a merger, acquisition or other corporate transaction.

 

Marketing and the Use of your Personal Information.

Where you have consented to receive marketing from Loqate or GBG we will only market to you via the channel you have consented to (such as email, telephone, etc.).  We use third-party service providers to manage our email marketing solutions.  When you receive an email from us it will include an unsubscribe link which you can click if you wish to unsubscribe from our marketing lists.  We will then add your email address to our suppression list, which will ensure you do not receive any further marketing from us.

Please be assured we do not sell your personal information to third party companies for marketing purposes.

Accuracy of your personal information

As part of the account management process GBG may, on a regular basis inquire if the personal information we hold about you is correct.  You can also ensure your personal information is correct by contacting us at Loqate_DPO@gbgplc.com.

Alternatively, if your organization has an agreement with Loqate for the provision of services, you can contact your Loqate account manager who will ensure they update your record on our CRM system.

 

Cross-Border Data Transfers

While Loqate is a U.S. based company, we are part of a global organization with business clients located all over the world. The Loqate servers that Loqate uses to process personal information are located in the United States and the United Kingdom. However, we may collect and transfer information we collect on you from our business clients who may use servers located in other countries outside of the one you are located in, where the privacy laws may be different from the country in which you reside or are located in. We will take appropriate technical, contractual, and organizational measures to try to ensure the security of your personal data when processed.

 

Cookies and Similar Technologies

When you browse our website we will collect the Internet Protocol (IP) address of the device you are using, but will be unable to identify you at this point. We collect this data so that we can identify where customers are dropping out of the website and to identify areas of improvement to make the experience more engaging for our customers.

We use Google Analytics to collect information about your interactions with our websites. You can opt-out of Google Analytics here: http://tools.google.com/dlpage/gaoptout (please note that you will be required to install a browser add-on should you wish to opt-out).

We use cookies on our website, so please see our Loqate Cookie Policy for more information.

We also use pixels in some of our HTML email messages. Email pixels are hyperlinks in remote images that are embedded in the email. The technology provides GBG with analytical information about the user experience and help us customize our marketing activities by monitoring ‘clicks’. No additional personal data is collected. For the avoidance of doubt, this does not include any sharing or selling of any data or any cross context behavioural advertising under US privacy laws. 

 

How long do we retain your personal information for and why?

Where we have collected your personal information for our own B2B marketing purposes we will retain your personal information for as long as you remain subscribed to our mailing lists or until the time when you inform us that you no longer wish to receive marketing from us.

For account management purposes, we will retain the personal information we collected from you for as long as we have the relationship with your organization. If GBG no longer has a relationship with your organization then we will only keep the relevant information, for example, such as invoices for audit purposes for 6 years after the relationship with GBG has ended. If GBG are informed that you are no longer the contact we need to liaise with or your leave your organization, we will remove your details from our system.

For information that our B2B business clients provided to us on you for us to perform our contractual obligations to them as their service provider, we will retain this information for as long as it is reasonably necessary for us to complete performance, for the duration of our legitimate business interests, and/or comply with any audit or legal obligations.

Security

We have put in place various security procedures by way of reasonable measures to protect your information. We consider the security of your personal data and the details of any transactions you make to be a matter of high priority. Your account information is protected by your account code and password which you should keep safe at all times. In addition to your password, we generate keys which are used to authenticate your account against our servers when you are querying the database. Keys are a randomly generated and unique set of letters and numbers. Third Party Site Links

Please be aware that our websites may direct you to other sites that we do not own or control. These other sites may use their own cookies and collect information on you. The privacy statements of these other sites will govern the collection and processing of your personal information. Therefore, we are not responsible for your use of third-party websites that are not owned by Loqate or GBG and cannot guarantee the security of any of the personal information that they collect from you since we do not have control over these third-party sites.

 

Changes to our Privacy Statement

The terms of this Privacy Statement may change from time to time. We will notify you of any material changes to this Privacy Statement by posting a prominent notice on our site. Changes will start to apply to information that we collect from the date on which the Privacy Statement was updated.

 

Your Rights under GDPR

If you are an individual whose personal information is located in the European Union, you may have rights under the GDPR regarding the use of your personal information. Your US Privacy Rights

This section describes how we collect, use, disclose, and otherwise process personal information of individual residents of the States of California, Virginia, Colorado, Connecticut, Utah, Oregon, Texas and Montana, either online or offline, in accordance with their corresponding privacy laws and regulations (each a  "US Privacy Laws" and collectively, the "US Privacy Laws"). For the purpose of this Privacy Policy “Personal Data” includes “personal information” as defined under the California Privacy Rights Act. All privacy rights requests will be actioned in accordance with its corresponding US Privacy Law.

 

California, Virginia, Colorado, Connecticut, Utah, Oregon, Texas and Montana residents may exercise the following rights below, as applicable to them, via:

  • Right to Know/Access. You have the right to request/access information on, the personal information we collected about you in the last 12 months,  including the categories of personal information, the categories of sources from which your personal information was collected from, the business or commercial purpose for collecting, selling, or sharing your personal information, the categories of third parties to whom we disclosed your personal information to, and the specific pieces of personal information we have collected about you. You have the right to obtain a copy of your personal information in a portable format;
  • Right to Delete. You have the right to request that we delete Personal Data that we have collected from you, subject to certain exceptions.
  • Right to Correct. You have a right to request that we correct inaccurate Personal Data that we maintain on you.
  • Right to Opt Out. You have the right to opt out of the sale of your Personal Data and targeted advertising. However please note that we do not sell your Personal Data or engage in targeted advertising.
  • Right to No Discrimination. You have the right not to receive discriminatory treatment by us for the exercise of your privacy rights. This includes employee, applicant, or independent contractor rights to not to be retaliated against for the exercise of your privacy rights. We will not discriminate against you, in any manner prohibited by applicable law, for exercising these rights.

Sensitive Personal Data: We will not use or disclose your sensitive personal information for purposes other than those specified in section 7027 of the California Consumer Privacy Act regulations, subsection (m).

Verification: In order to exercise your rights, we will need to obtain information to locate you in our records and verify your identity depending on the nature of the request. If you are submitting a request on behalf of a household, we will need to verify each member of the household in the manner set forth in this section.

  • For Right to Know, Right to Correct, and Right to Delete, we will request an ID Document, as well as information on your First Name, Last Name, , Email Address, Phone, Postal Address, and Date of Birth to verify your identity and ask that you declare, under penalty of perjury, that you are who you say you are.
  • For Right to Opt-Out, we will only request that you provide us with First Name, Last Name, Email Address, Phone, Postal Address, and Date of Birth (but we will not verify your identity and therefore will not need you to provide an ID document).

Authorized Agents: You may use an authorized agent to exercise your rights on your behalf, in accordance with your applicable US Privacy Law. If you are making any of the requests above through an authorized agent, we will request written authorization from you and will seek to verify you as described above or (for California residents) we will accept a legal Power of Attorney under the California Probate Code to the authorized agent. To make a request using an authorized agent, use our webform and have the agent upload documentation demonstrating you have authorized them to exercise rights on your behalf.

Appeal: If you are a resident of a US State that allows you to appeal a decision we have made in connection with your attempt to assert a right under applicable US Privacy Law, you may file an appeal of our decision by contacting us at Loqate_DPO@gbgplc.com. Please ensure you provide us with the postal address in which you reside, accompanied with details for the basis of your appeal.

Your jurisdiction may allow you to file a complaint regarding any concerns with the result of your appeal request. US residents whose states have enacted an applicable privacy law may file a complaint with their corresponding state’s Attorney General or dedicated Agency if they have concerns about the result of the appeal.

Timing: We will respond to Requests to Delete and Requests to Know, and Requests to Correct, in compliance with the applicable US Privacy Law, within 45 days, unless we need more time in which case we will notify you and may take up to 90 days total to respond to your request.

Minors under 16: Please note that we do not knowingly collect or disclose personal information in relation to minors under the age of 16.

 

Your Nevada Notice

If you are a resident of the State of Nevada, you may opt out of future sales of certain covered information that a website operator has collected or will collect about the resident.
